The best assessment I can make is federal resources flailing about randomly with no apparent purpose, expending great amounts of energy to accomplish not very much.

One of the first Gulf oil spill actions was to dispatch several teams of lawyers to the gulf. What these attorneys would do to stop the leak or reduce damage has not been reported in the media. The next step was to dispatch SWAT teams to other platforms. Color me doubtful, I have never seen a disaster plan that expended resources on undamaged facilities or sent in teams of attorneys." How to Think About Oil Spills

"As with Three Mile Island, the hysteria of the media and the political class over the Deepwater spill is likely to lead to increased risk and adverse environmental tradeoffs. It is understandable that the Deep-water spill is generating such intense fury. The 24/7 “spillcam” is giving a whole new meaning to “live-streaming video,” and unlike tanker spills, which are bounded by the contents of the tanker, the open-ended nature of an offshore platform spill generates more dread.

In short, there is considerable risk that overreaction to the BP/Deepwater spill will have second-order environmental impacts that could be cumulatively worse than the spill itself, both for the Gulf and for other environmental arenas. Even if the costs of the spill exceed $15 billion (to be borne by BP) as now seems likely, the benefits of continued offshore oil production still exceed the costs by a wide margin. Economist Peter Passell estimates a net economic benefit of nearly a trillion dollars from continued offshore production. This will not be a popular position to hold so long as live streaming video of the oil spill continues and the media continue to cover the spill in a state of near hysteria. But it is at precisely such times that rational analysis needs to be heard. " [Weekly Standard]

An Oil Spill Is Not a License to Suspend the Rule of Law

If you try to find the power in the constitution that allows Obama to do this, you will be even more disturbed. In this case the government can't even claim the commerce clause of the constitution as legal basis because the commerce clause, even misinterpreted as it is, only applies to the legislature, not the executive branch. Where exactly in the enumerated powers of the constitution does the president have the right to "demand" money from a corporation, deem them guilty of a crime and extract a settlement amount? Gulf Spill Equivalent to Peeing in the Thames ?

Lets see if I've got this correct...........
The Gulf of Mexico holds 6.43 x 10^17 gal of water.
The oil spill is leaking 1.3 x 10^8 gal per day
That is a ratio of about 5 x 10^9 to 1, or 5,000,000,000 to one sea water to oil.

The Thames River at London flows about 1.25 x 10^9 gal per day
If I pee'd in the Thames every day, I would add about 0.5 gal per day
That is a ratio of about 2.5 x 10^9 to 1, or 2,500,000,000 to one river water to pee.

So if two of us pee'd in the Thames, we'd be polluting it the equivalent of the "disastrous" BP oil spill.

Let me know if my calculations are badly off .........

Obama's blatant lie - that we " have less than 2% of the world's oil reserve" - while pushing his politics rather than solutions to the spill problem, obfuscates the fact that our ecology is being damaged..... BIRDS ARE DYING, Mr. PRESIDENT .... while you push politics!!
